The South Dakota minimum wage increases from $6.55 to $7.25 per hour effective July 24, 2009, to reflect an increase in the federal minimum wage. Tipped employees must be paid $2.13 per hour; however, tips and wages combined must average $7.25 per hour. The Division of Human Rights enforces the South Dakota Human Relations Act of 1972 prohibiting workplace discrimination based on race, color, creed, religion, sex, pregnancy, ancestry, disability or national origin. An employee called to jury duty may not be fired or demoted due to the absence. However, there is no requirement for the South Dakota employer to pay the worker for jury duty.*
